Terms and conditions (“Terms”) are a set of legal terms defined by the owner of a website. At Southern Star Scientific the owners and staff of course are also shoppers, so we naturally respect all rights of the shoppers / customers. Site Terms and Conditions should be displayed on every website that you visit, as they set forth the terms and conditions governing the activities of the website visitors on the said website and the relationship between the site visitors and the website owner. The Terms are an agreement between the website owner and the users of the website; they detail the policies and procedures conducted by the website to ensure that you are a fully informed customer.
This website is owned and operated by Southern Star Products LLC, Address: Oro Valley, Arizona, USA. Southern Star Products LLC has a DBA (Doing Business As) Southern Star Scientific (website: www.ozonegenerator.com and www.southernstarscientific.com) . These Terms set forth the terms and conditions under which you may use our website and services as offered by us. This website offers visitors descriptions, photos, and technical capabilities of several products. Our website also clearly posts documents (pages) that describe the framework of the relationship between our customers/shoppers and our company through our web page www.ozonegenerator.com/legal. On this page you will find articles that will inform all shoppers/customers of our Return/Refund/Cancellation policy, our Fulfillment and Shipping Policy, our Security Statement, our Privacy Policy, our Anti-Spam Policy and of course this document you are reading now, our Site Terms and Conditions agreement. By accessing or using the website of our service, you approve that you have read, understood, and agree to be bound by these Site Terms and Conditions, and that you have fully informed yourself of the other policies mentioned here.
In order to use our website and/or receive our services, you must be at least 18 years of age, or of the legal age of majority in your jurisdiction, and possess the legal authority, right and freedom to enter into these Terms as a binding agreement. You are not allowed to use this website and/or receive services or products if doing so is prohibited in your country or under any law or regulation applicable to you.
When buying an item, you agree that: (i) you are responsible for reading the full item listing before making a commitment to buy it: (ii) you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process.
The prices we charge for using our services / for our products are listed on the store portion of our website. We reserve the right to change our prices for products displayed at any time, and to correct pricing errors that may inadvertently occur. Refund/ Return /Order Cancellation Policy – A Generous 3 Tier Policy:
We greatly appreciate your trust and faith in Southern Star Scientific, our company, employees, and the equipment we manufacture. As such we have implemented generous return policies that exceed those of all other companies in the ozone industry. We are shoppers too, so our goal has always been to treat our customers as we would like to be treated by the companies we deal with. We believe you will be pleased with the Refund, Return, and Order Cancellation Policies you find here. There are 3 stages to our return policy:
1. Full Refund for cancellations are provided to customers who cancel their order before shipping takes place. After the product has been shipped, the order cannot be cancelled. If the product has been consigned to a shipper to deliver the product to the customer, in order to return any product, the customer must first obtain an RMA (Return to Manufacturer Authorization) number from Southern Star staff. The customer is responsible for obtaining that RMA either by telephone or email.
2. Full Refund After Receipt: No other ozone company will provide you with this "Full Refund After Receipt" Policy
After the customer receives the product we provide every customer with generous 10 days to inspect the product to ensure that the product quality meets your expectations. In the unlikely even that the product does not satisfy the quality expectations of our customer, the products can be returned for a full refund (minus original and return costs of shipping). Please note that the technical aspect of this Refund Offer requires that the products begin their journey back to our company within 10 days after the products were delivered to the address provided by the customer as the delivery address. When the products arrive in “new” condition when returned, a full refund will be granted, minus the original shipping charges (plus the customer will pay for the return shipping charges). In the unlikely event that the products are not returned in “new” condition (the products have suffered some damage and/or are no longer in "new" condition, customer will be responsible to pay for any repairs necessary to bring the product back to new condition. This amount will be removed from the refund. (If returning products we would recommend purchasing full value insurance from the shipping company.)
3. 30 Day Return Policy: We offer every customer a full 30 days to return the products to us. If the first "10 day period" following delivery of the product to the customer's address has expired, customers still retain the right to return the products to Southern Star Scientific for the next 20 days. To clarify, if the customer who wish to return their products for a refund after day 10, they must ensure the products are shipped back to Southern Star Scientific before 30 days after they received the products. Accordingly, if the customer ships the product within 30 days of receipt, Southern Star Scientific will provide a full refund of the product minus a 15% restocking fee. Please make special note that no refunds are provided on "used" accessories. In order for an accessory to qualify for a refund (original price minus 15% restocking fee) the accessories must not have been used, and they must remain in their sealed packages. Accessories that have been used or are not in their original sealed packages do not qualify for a refund. If the products are not returned in "new" condition the cost of returning the product to "new" condition will be deducted from the customer refund. If the products are damaged during shipment back to the manufacturer, the cost of repairing the product to return it to "new" condition will be deducted from the customer refund If the products are damaged during the journey back, the cost to return the products to 'new' condition will be deducted from the refund owed to the customer. For this reason we suggest that products being returned should be covered by a full insurance policy purchased from the shipping company that the customer has consigned to return the products to the manufacturer. If insurance is purchased, then the customer can recoup the cost of the repair or replacement of the damaged or lost product by making an insurance claim with the shipping company.
Fulfillment/Shipping Policy
We normally have products in stock so the standard time frame between order and shipment is 2 business days. Our goal is that products will be shipped to the customer between 1 and 7 days of placement of the order. Customers are reminded that their order remains fully refundable from the day of purchase to the moment the product is consigned to the courier. Shipping service is the choice of the customer as we offer Express (1 day), Expedited (2-3 days), and Standard Ground shipment (time to delivery is dependent upon “ship to” address. Not all services are available to all customers as services depend upon the courier providing the services and destination of the products.
We may, without prior notice, change the services and/or products; stop providing the services, products, or any features of the services and products we offer; or create limits for the services. We may permanently or temporarily terminate or suspend access to the services or products without notice and liability for any reason, or for no reason.
Warranties on Products Purchased
When we receive a valid warranty claim for a product purchased from us withing the product warranty period, we will either repair the relevant defect or replace the product (at our discretion). The customer must first obtain an RMA number (Return to Manufacturer Authorization) from one of our Customer Support staff members. This is required so that our Customer Staff members can discuss the malfunction of the product with the customer to ensure there actually is a malfunction and not simply a misunderstanding of how to use the product. If it is determined that there is a malfunction that requires the product to be returned to the manufacturer then the RMA is issued, and instructions provided as to how to return the product to the manufacturer. For a warranty claim the customer is responsible for shipping charges of the product to the manufacturer, the cost of insuring the product for its value, and the return shipping charges from manufacturer back to the customer. When the product is received by the manufacturer the product will be inspected as soon as possible and repaired as soon as possible. The time required for the repair will be dependent upon the details of the repair that is required. Our technicians will make every effort possible to repair the product as soon as possible, and return to the customer.
If in the course of inspection of the product in the factory it is determined that we are unable to repair the product, then a replacement product will be provided. In the unlikely event that we are unable to repair or replace the product that had a malfunction within the warranty period (not caused by the customer or conditions under which the product was being unitized) within a reasonable time, the customer will be entitled to a full refund.
Ownership of intellectual property, copyrights and logos
Regarding the design, content, written material, and all other materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all other Intellectual Property Rights related thereto, are the exclusive property of Southern Star Products LLC DBA Southern Star Scientific. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof.
Right to suspend or cancel user/customer account
We may permanently or temporarily terminate or suspend your access to service and products without notice and liability for any reason, including if in our sole determination you violate any provision of these Terms or any applicable law or regulations. You may discontinue use and request to cancel your account and/or any services at any time.
Indemnification
You agree to indemnify and hold Southern Star Products LLC (DBA Southern Star Scientific) harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against them by any third party due to, or arising out of, or in connection with your use of the website or any of the services offered on the website.
Limitation of Liability
To the maximum extent permitted by applicable law, in no event Southern Star Products LLC (DBA Southern Star Scientific) be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the products or services.
To the maximum extent permitted by applicable law, Southern Star Products LLC (DBA Southern Star Scientific) assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our products or services; and (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.
Right to Change and Modify Terms
We reserve the right to modify these terms from time to time at our sole discretion. Therefore, you should review this page periodically. When we change the Terms in a material manner, we will notify you that material changes have been made to the Terms. Your continued use of the Website or our products and services after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) the website or the services.
Promotional emails and content
By entering into a customer / supplier agreement with us you agree to receive from time-to-time promotional messages and materials from us, by mail, email or any other contact form you may provide us with (including your phone number for calls or text messages). If you don't want to receive such promotional materials or notices – please just notify us at any time. Further information can be found in our Anti-Spam policy that is also posted on this site.
Preference of law and dispute resolution
These Terms, the rights and remedies provided hereunder, and any and all claims and disputes related hereto and/or to the services, shall be governed by, construed under and enforced in all respects solely and exclusively in accordance with the internal substantive laws of USA, Arizona, without respect to its conflict of laws principles. Any and all such claims and disputes shall be brought in, and you hereby consent to them being decided exclusively by a court of competent jurisdiction located in Oro Valley AZ. The application of the United Nations Convention of Contracts for the International Sale of Goods is hereby expressly excluded.
